The terms and conditions contained in this User Policy are framed in compliance with all the Laws that are in force in India and any other country Laws to which the user of this Website belongs. The acceptance of the Terms & Conditions by the User shall be considered as a valid contract under the Indian Contract Act, 1872. All notices under this agreement will be considered as written and have been duly signed once the same is electronically confirmed. The Terms and Conditions of this User Policy are framed by SeekMyCourse AI Technologies Pvt Ltd.

3.3. Personal Use License: Any course generated by you, any Pre-Generated Courses, or any Practice Quizzes provided by the Service are for your personal, non-commercial use only. You are strictly prohibited from reselling, distributing, sharing, or otherwise commercially exploiting any content obtained from SeekMyCourse.

4. SERVICES PROVIDED BY SEEKMYCOURSE:

4.1. AI-Powered Course Creation: The Platform (SeekMyCourse) leverages advanced artificial intelligence technology to create high-quality educational content, including but not limited to:

• Custom Course Modules: Development of tailored courses based on specific topics, learning objectives, and audience requirements.
• Learning Pathways: Dynamic generation of step-by-step learning paths suited to the learner’s knowledge level, goals, and pace.
• Interactive Content: Integration of interactive quizzes, exercises, and assessments within the course materials.
• Multi-Language Support: Courses can be generated in multiple languages for global accessibility.

4.2. Free and Premium Services: SeekMyCourse offers both free and premium services. Access to Pre-Generated Courses and Practice Quizzes is provided free of charge. Access to advanced features, including AI-powered course creation, may require a subscription.

4.3. Multimedia Integration: The Platform (SeekMyCourse) supports the incorporation of multimedia elements to enhance the learning experience, primarily by pulling video content from YouTube via its search API.

4.4. Service Limitations and Disclaimers:

• AI-Generated Content: The content for courses, including text and quizzes, is generated by artificial intelligence. While we strive for accuracy, SeekMyCourse provides a 99.9% accuracy rate most of the time. However, we do not guarantee that all information will be completely accurate or up-to-date. Users should use the content as a learning guide and are encouraged to verify critical information.
• Multilingual Translations: The multilingual feature is also powered by AI translation. While it achieves approximately 99% accuracy most of the time, translations may contain errors or nuances that are not perfectly captured.
• Third-Party Video Content: SeekMyCourse is not the intellectual property holder of the videos sourced from YouTube. All rights, title, and interest in and to the video content remain with the original creator. We provide attribution to the original creator as available through the YouTube API.

5. USER RESPONSIBILITIES:

5.1. Account Security: You are solely responsible for maintaining the security of your account. You must notify us immediately if you become aware of any unauthorized access or use of your account.

5.2. User Conduct: You agree to use the Service (SeekMyCourse) only in compliance with all applicable laws and regulations, including but not limited to:

• The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
• Consumer Protection Laws of India.
• Information Technology Act, 2000 and applicable Indian data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act).
• All other relevant local, national, and international laws.

6. DATA PROTECTION AND PRIVACY:

6.1. Data Collection and Usage: We (SeekMyCourse AI Technologies Pvt Ltd) are committed to protecting your privacy and data. By using the Service, you consent to our collection, use, and sharing of personal information as outlined in our Privacy Policy. We will handle your personal information in accordance with our Privacy Policy and all applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (DPDP Act) in India.

7. INTELLECTUAL PROPERTY:

7.1. Platform Intellectual Property: All proprietary technologies, algorithms, designs, software, and other intellectual property (collectively, "Platform IP") are the sole property of SeekMyCourse AI Technologies Pvt Ltd or its licensors.

7.2. User-Generated Content: All content generated by you using the Platform’s tools remains your intellectual property. However, by generating content, you grant SeekMyCourse a worldwide, royalty-free license to use, reproduce, and display that content solely for the purpose of providing the Service to you.

7.3. Use of Third-Party Video Content: SeekMyCourse utilizes the YouTube API to search for and embed relevant educational videos into courses.

• Ownership: SeekMyCourse does not claim any ownership or intellectual property rights over the videos. The original creator of the video is the intellectual property holder.
• Compliance: Users must adhere to the YouTube Terms of Service when interacting with embedded video content.

8. FEES AND PAYMENTS:

8.1. Subscription Fees: Access to premium features of the Service (SeekMyCourse) may require a subscription. All fees are outlined on our website in INR (Indian Rupees) and are subject to change.

8.2. Non-Refundable: All payments made to us are non-refundable, except where required by law.

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY:

10.1. No Warranty: The Service (SeekMyCourse) is provided “as is” and “as available,” without any warranties, express or implied. We do not guarantee that the Service will be error-free or that the AI-generated content and translations will be 100% accurate at all times.

10.2. Limitation of Liability: To the fullest extent permitted by applicable law, SeekMyCourse AI Technologies Pvt Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service.

10.3. Indemnification: You agree to indemnify and hold harmless SeekMyCourse AI Technologies Pvt Ltd from any claims or damages arising from your use of the Service or your violation of these Terms.

11. TERMINATION:

11.1. Termination by Us: We (SeekMyCourse AI Technologies Pvt Ltd) reserve the right to suspend or terminate your account at our sole discretion, with or without notice.

12. Cancellation Policy

This Cancellation Policy outlines the terms and conditions regarding the cancellation of subscription plans for the services provided by SeekMyCourse AI Technologies Pvt Ltd ("SeekMyCourse", "We", "Us", "Our"). Please read this policy carefully.

12.1. SUBSCRIPTION AND AUTOMATIC RENEWAL:

12.1. Automatic Renewal: All our subscription plans are offered on an automatic renewal basis. This means that your subscription will be automatically renewed at the end of each billing cycle (typically, monthly) unless it is cancelled by you.

12.2. Billing: By signing up for a subscription plan, you authorize Us to charge the applicable subscription fee to your chosen payment method at the beginning of each billing cycle. The auto-debit or recurring payment mandate you set up is an agreement between you and your financial institution (bank or credit card provider).

12.2. CANCELLATION PROCEDURE:

12.2.1. User Responsibility: To cancel your subscription and stop the automatic renewal, you must cancel the auto-debit mandate directly with your bank or financial institution. SeekMyCourse does not have the authority to cancel recurring payment mandates on your behalf, as this is a direct agreement between you and your bank.

12.2.2. How to Cancel: You will need to log in to your bank's net banking portal, mobile banking application, or contact your bank's customer service to find and cancel the specific auto-debit instruction set up for SeekMyCourse AI Technologies Pvt Ltd. The exact procedure may vary depending on your bank.

12.2.3. Timing of Cancellation: To avoid being charged for the next billing cycle, we recommend you cancel the auto-debit mandate at least 48-72 hours before your next scheduled payment date. We are not responsible for charges incurred because of a late cancellation.

12.3. EFFECT OF CANCELLATION:

12.3.1. Continued Access: Once you successfully cancel your auto-debit mandate, your subscription will not renew at the end of the current billing period. You will continue to have full access to the premium features of your plan until the last day of your current paid billing cycle.

12.3.2. No Prorated Refunds: As stated in our Terms of Service, all payments are non-refundable. We do not offer prorated refunds or credits for any partial subscription periods. Cancelling your subscription will only prevent future charges.

13. GOVERNING LAW AND DISPUTE RESOLUTION:

13.1. Governing Law: These Terms shall be governed by the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India.
